Our judicial system here in America has become unwelldly because there are too
many laws and regulations that can be broken by too many people, so the cops are
arresting too many people, the prosecutors are prosecuting too many people, and the
corrections department is incarcerating too many people. The whole system is so
overwhelmed on the criminal side that the problem is almost without solution -- except
to lower the number of laws. But with the criminal justice system we can ease their
burden by decriminalizing a lot of acts, and we can simply make less criminals.
We could also strengthen the rules of evidence. Along with putting some sort of
more stringent oversight into the grand jury proceedings. Prosecutors have too much
power and they are driven to use it by their bids to get reelected.
Another problem that has been creeping into the criminal justice system is the
idea that the government has the right to do all sorts of things, more and more in
secret and more and more trampling on the rights of individuals.
The RICO statutes and the forefetiure laws are encouragning proseutors and
police to abuse their powers as they see more glory and resources for their offices.
They are taking on the trappings of a despotic states.
